Optic One Opticals LLC maintains the OPTICONE.AE Website (“Site”). The following are the terms of use that govern use of the Site (“Terms of Use”). By using the Site you expressly agree to be bound by these Terms of Use and the OPTICONE.AE privacy policy and to follow these Terms of Use and all applicable laws and regulations governing use of the Site. OPTIC ONE OPTICALS LLC reserves the right to change these Terms of Use at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. We will note when there are updates to the Terms of Use at the bottom of the Terms of Use. If you violate these Terms of Use, OPTIC ONE OPTICALS LLC may terminate your use of the Site, bar you from future use of the Site, and/or take appropriate legal action against you.

LIMITED LICENSE. You are granted a limited, non-exclusive, revocable and non-transferable license to utilize and access the Site pursuant to the requirements and restrictions of these Terms of Use. OPTIC ONE OPTICALS LLC may change, suspend, or discontinue any aspect of the Site at any time. OPTIC ONE OPTICALS LLC may also, without notice or liability, impose limits on certain features and services or restrict your access to all or portions of the Site. You shall have no rights to the proprietary software and related documentation, if any, provided to you in order to access the Site. Except as provided in the Terms of Use, you shall have no right to directly or indirectly, own, use, loan, sell, rent, lease, license, sublicense, assign, copy, translate, modify, adapt, improve, or create any new or derivative works from, or display, distribute, perform, or in any way exploit the Site, or any of its contents (including software) in whole or in part.

1. SITE OPERATION: United Arab Emirates is our Country of Domicile. OPTIC ONE OPTICALS LLC controls this Site from the U.A.E. OPTIC ONE OPTICALS LLC makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

APPLICABLE LAW. The Laws of the United Arab Emirates shall govern the use of the Site and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E.

PURCHASES & PAYMENTS . OPTIC ONE OPTICALS LLC accepts payment by Visa, Mastercard debit and credit cards, tabb and , cashew BNPL apps and cash on delivery- in AED for its products and services.

All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of OPTIC ONE OPTICALS LLC. All refunds will be made onto the original mode of payment.

By placing an order with Optic One, the Buyer acknowledges that he has read these terms and conditions and complies with them. By completing a purchase and by ticking the box on your order that you have read and understand our terms and conditions, you are verifying that you are of legal age to enter into a binding contract and in possession of a valid prescription for the lenses you are ordering. You hereby confirm that the information you are providing is valid and exactly as prescribed by your eye-care professional. You, the customer, give your consent to our contacting your eye-care professional or representative to verify your prescription information, if necessary. You understand that it is your responsibility to undergo regular eye examinations and maintain an up-to-date prescription. Optic One is not responsible for any consequences as a result of deviation from your prescription.

3. TRANSACTIONS , REJECTIONS AND CANCELATION OF ORDERS. Prices at OpticOne will be as stated on the website. Prices and availability are subject to change at any time and without notice.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or delivery address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Optic One Opticals may refuse or reject any order at any time, refunding you (monies you have paid as per the Return policy) for the order, for reasons which include- but are not limited to- if you have not met the conditions specified at the time of the order, if your payment cannot be processed, if the ordered items or services are not available, or for obvious errors on the website or made in connection with your order in which case we will cancel your order.

DELIVERY TIMES OF NON-STOCK GOODS. Some contact lenses might not be in our stock. We will reserve these for you and order them directly from the producer. The dispatching of special contact lenses that are not stocked frequently depends on the delivery conditions of our suppliers and can vary from 3-4 days to 3-8 weeks. If the lenses will take more than a week to deliver, we will try to notify you by call or email first and awaits your confirmation to proceed with the order.

4.PAYMENT CONFIRMATION. Once the payment is made, the confirmation notice will be sent to the client via email within 24 hours of receipt.

5.PROOF OF PURCHASES AND INVOICE ; If the Buyer does not mention explicitly in the field „Additional notes“ that he requires a printed proof of purchase , he agrees that they will be supplied in an electronic notifications only. However invoices can always be obtained by contacting our customer care.

We use a standard tax invoice to adhere the laws of UAE. The invoice structure cannot be altered or additional details cannot be added.

5. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES. OPTIC ONE OPTICALS LLC will not trade with or provide any services to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not countryspecific

6. REPRESENTATIONS BY YOU. By visiting the Site, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that all materials of any kind submitted by you to OPTIC ONE OPTICALS LLC through the Site or for inclusion on the Site will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.

7.LIABILITY  Optic One Opticals LLC, any other party (whether or not involved in creating, producing, maintaining or delivering this website) and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, revenue, reputation, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with this website in any way or in connection with the use, inability to use or the results of use of this website, any websites linked to this website, or the items, services or materials on such websites, including but not limited to unavailability of a item, item defect, quality and performance of a purchased item, loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this website or your downloading of any material from this website or any websites linked to this website.

8. PERMITTED USE. Customers are free to use our website either as guests or as registered users. The customer is required to use our site responsibly and correctly, abiding by our terms and conditions. In case of misuse, Optic One has the right temporarily or permanently ban the user from using our website and services.

9. YOUR ACCOUNT. If you use OPTIC ONE OPTICALS LLC Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any devices, and you agree to accept responsibility for all activities that occur under your account or password. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.

10.ERRORS & INACCURACIES. Occasionally there may be information on our website that contains typographical errors, inaccuracies, or omissions that may relate to item descriptions (includes but not limited to model details and size ) pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on OPTICONE.AE is inaccurate at any time without prior notice (including after you have submitted your order).

11. COLORS.  We have made every effort to display as accurately as possible the colors of our items that appear at OPTICONE.AE. We cannot guarantee that your computer’s monitor/ mobile screen display of any color will be accurate and will not be accepted as a reason for return.

12.NO COMMERCIAL USE. This Site may not be used by you for any commercial purposes such as to conduct sales of merchandise or services of any kind. You must obtain OPTIC ONE OPTICALS LLC’s prior written consent to make commercial offers of any kind on the Site, whether by advertising, solicitations, links, or any other form of communication. OPTIC ONE OPTICALS LLC will investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Site and barring such violators from use of the Site.

13.COPYRIGHT POLICY. OPTIC ONE OPTICALS LLC may terminate the privileges of any user who uses this Site to unlawfully transmit copyrighted material without a license, express consent, valid defense or fair use exemption to do so. If you submit information to this Site, you warrant that the information does not infringe the copyrights or other rights of third parties.

14.INTELLECTUAL PROPERTY. Although OPTIC ONE OPTICALS LLC is not responsible for the content, quality or accuracy of data provided by users, compilations of such data, text, information and other materials made available to users through OPTIC ONE OPTICALS LLC’s system. The On-line Materials are OPTIC ONE OPTICALS LLC’s intellectual property.The On-line Materials may not be copied or redistributed either in whole or in part without prior written consent of OPTIC ONE OPTICALS LLC, except as expressly and specifically permitted under these Terms of Use.

The On-line Materials are and will remain the exclusive property of OPTIC ONE OPTICALS LLC. All rights, titles and interests in and to the On-line Materials will be and remain vested solely in OPTIC ONE OPTICALS LLC. Under no circumstances will you have any right, directly or indirectly, to own, use, copy, loan, sell, rent, lease, license, sublicense, redistribute, assign or otherwise convey the On- line Materials, or any rights thereto, except as expressly and specifically provided in the Terms of Use. Nothing in these Terms of Use will convey to you any right, title or interest, except that of a license with the express rights and subject to all limitations herein. Nothing in these Terms of Use grants you the right, directly or indirectly, to use the On-line Materials to create a product for resale or to use the On-line Materials in any way that competes with OPTIC ONE OPTICALS LLC.

You acknowledge and agree that OPTIC ONE OPTICALS LLC will own all rights, titles and interests in and to any copy, translation, modification, adaptation, derivative work or improvement of the On- line Materials made by or for you. At OPTIC ONE OPTICALS LLC’s request, you must execute, or obtain the execution of, any instrument that may be necessary to assign these rights, titles or interests to OPTIC ONE OPTICALS LLC or perfect these rights, titles or interests in OPTIC ONE OPTICALS LLC’s name. DISCLAIMER OF WARRANTY, LIMITATION OF DAMAGES. OPTIC ONE OPTICALS LLC MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTY OF TITLE OR NON-INFRINGEMENT OR IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,NON-INFRINGEMENT OR OTHER VIOLATION OF RIGHTS IN RELATION TO THE AVAILABILITY, ACCURACY, VALIDITY, RELIABILITY OR CONTENT OF THESE PAGES AND/OR THE SITE. OPTIC ONE OPTICALS LLC ALSO DOES NOT MAKE ANY REPRESENTATION OR WARRANTY REGARDING THE ACCURACY OR RELIABILITY OF ANY ADVICE, OPINION, STATEMENT OR OTHER INFORMATION THAT IS SUBMITTED, DISPLAYED OR UPLOADED THROUGH THE SITE BY ANY USER. OPTIC ONE OPTICALS LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR FOR BUSINESS INTERRUPTION ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SITE, EVEN IF OPTIC ONE OPTICALS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THE LIABILITY OF OPTIC ONE OPTICALS LLC WOULD IN SUCH CASE BE LIMITED TO THE GREATEST EXTENT OF LIABILITY PERMITTED BY LAW.

.VIOLATION OF TERMS OF USE. You understand and agree that in OPTIC ONE OPTICALS LLC’s sole discretion, and without prior notice, OPTIC ONE OPTICALS LLC may terminate your access to the Site, or exercise any other remedy available and remove any unauthorized user information, if OPTIC ONE OPTICALS LLC believes that the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of OPTIC ONE OPTICALS LLC, or any third party, or violates the law. You agree that monetary damages may not provide a sufficient remedy to OPTIC ONE OPTICALS LLC for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. OPTIC ONE OPTICALS LLC may release user information about you if required by law or subpoena.

INDEMNITY. You agree to indemnify and hold OPTIC ONE OPTICALS LLC, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of or relating to your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site, or your breach of the Terms of Use.

LICENCE GRANTED TO YOU. By providing materials to OPTIC ONE OPTICALS LLC, including by submitting or uploading content or materials for use on the Site you represent and warrant that you or the owner of all rights to such content or materials has expressly granted OPTIC ONE OPTICALS LLC an irrevocable world-wide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you. OPTIC ONE OPTICALS LLC may publish and distribute any such submitted content or materials at its sole discretion by any method now existing or later developed. You agree that you shall waive all claims and have no recourse against OPTIC ONE OPTICALS LLC for any alleged or actual infringement or misappropriation of any proprietary rights in any communication, content or material submitted to OPTIC ONE OPTICALS LLC. Any communication or materials you send to OPTIC ONE OPTICALS LLC will be treated as non- confidential and non-proprietary and may be disseminated or used by OPTIC ONE OPTICALS LLC for any purpose, including, but not limited to, developing, creating, manufacturing or marketing products or services.

SEVERABILITY. If any provision of the Terms of Use is held to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force and effect.

15.WARRANTY OF PRODUCTS. Frames & Sunglasses ( excluding final-sale items , clearance sale items((including but not limited to the products with a final-sale badging), swimming goggles, safety eyewear, sports prescription goggles and contact lenses ) are covered for one year warranty for any manufacturing defects. if you found out that there’s a manufacturing defect on the eyewear that you have purchased, please contact us and return the product to us to examine the product by our experts. If we detect a manufacturing defect on the product, either he product or the defective part will be replaced, based on the availability and scope of the warranty.

16. Contact Lens Purchase Terms & Conditions

1. The colors seen on the product pages may be different from those of the actual products received due to the variance in displays and monitors used by customers. Also, the colors of the products also depend on the unique color of an individual’s eyes. We will not be responsible for an unintended appearance of lenses on an individual’s eye.
2.  It is not necessary to submit a prescription for an order, but Optic One shall not be held liable for mistakes caused by misreading the prescription ordering a wrong power of lenses. We may offer alternations in the order or replacements in the possible cases under at discretion. However, there will not be any refund/ return or cancellation if a special order / custom-made lenses are wrongly ordered.
3. Contact lenses can be returned only if you received a wrong power. (Either sent a wrong power by us, or you have ordered a wrong power). However, contact lenses will not be exchanged/refunded if the package is opened, in any case. The customer bear the price of return in case of a wrong order.
4. Contact lens solutions and accessories are not eligible for return, unless due to manufacturing defects.
5. Custom-made lenses (including ,but not limited to XR series lenses) are not eligible for return or cancel the order.
6. The customer bears responsibility for the shipping costs associated with returning the product(s) ordered incorrectly or no longer needed. However, if Optic One is deemed to be at fault as the seller, any costs for returning will be covered.
7. Contact lenses prescription options provided on the website (opticone.ae) are intended for ordering purposes only. It is important to note that the availability of all power combinations in stock cannot be guaranteed at all times. Some combinations may require special orders, which may result in a waiting period of approximately 4-8 weeks for them to arrive. The specific delivery time for special orders varies depending on the brands involved. Upon receiving an order, we will contact the customer via WhatsApp or call to reconfirm if they would still like to proceed with the special order. It is at this point that the customer will have an opportunity to make a final decision. However, once special orders are confirmed by the customer, they can no longer be cancelled, refunded, or returned as the order is processed as per the customer’s request.
8. Optic One does not provide free exchanges, free-returns or refund services in the following cases

6a) Ordering errors and wrong shipping addresses

6b) Choosing the wrong prescription by misreading prescriptions

6c) Simple remorse by customer

6d) Colors of lenses aren’t same as seen on the product page images.

6e) Items are damaged or contaminated after they have been received by the recipient by mishandling/ carelessness .

17. Pick Up & Delivery Service Terms & Conditions

1. Prescription and Measurements:
   • The customer is responsible for providing accurate prescription details and any other related measurements required for lens replacement.
   • Optic One will not be held liable for any missing or incorrect information provided by the customer.
2. Packaging and Transit:
   • It is the customer’s responsibility to securely pack the sunglasses or eyeglasses before sending them to Optic One.
   • Optic One will not be responsible for any damage incurred during transit due to improper or non-safe packing by the customer.
3. Challenging Frames or Sunglasses:
   • If Optic One finds a frame or sunglasses difficult or impossible to work on after receiving the item, the customer will be promptly informed.
   • Please note that we accept any existing frames for lens replacement at the customer’s own risk. We have highly skilled technicians and advanced lab equipment, but sometimes worst things can happen while fitting lenses in an old frame because of wear and tear. Optic One will not be responsible for any damages that can occur while fitting the lenses during fitting due to the frames’ aging/wear and tear. t
   • In such cases, Optic One will return the product as received and provide a full refund.
4. Sunglass Tints and Polarized Lenses:
   • While Optic One will make every effort to match requested tints, exact replication based on existing tints or pictures may not be possible.
   • For polarized lenses, they come in standard tints, and Optic One will not provide replacements if the colors differ from what is seen in images.
5. Misaligned Frames and Repairs:
   • Optic One will not be held responsible if a misaligned frame is received, unless specifically instructed by the customer to fix or repair it.
   • If you need additional adjustment or alignment services for the eyeglasses, we can perform them at your own risk
6. Optic One reserves the right to accept or reject the request of the service
7. By utilizing our eyeglasses pick-up and delivery service, the customer acknowledges and agrees to the above terms and conditions. It is recommended to carefully review and understand these terms before proceeding with the service.Optic One remains committed to delivering high-quality service and customer satisfaction.

Headings & section titles in this Agreement are for convenience and do not define, limit, or extend any provision of this Agreement.

Optic One reserves the right to modify these terms and conditions at any time. Any such modifications will be effective immediately upon posting on our website.
